Harsh Penalties for Felony Assault of a Police Officer in Newark, New Jersey
An arrest warrant was issued for Plummer. When police locate him, he will likely face criminal charges for aggravated assault and assault by auto. Aggravated assault in NJ is often classified as a third or fourth degree felony, meaning that carries more severe penalties than simple assault (a disorderly persons offense). When an assault is committed against a police officer, those charged can be elevated further to a second degree felony. A conviction for second degree aggravated assault against a police officer can potentially result in a sentence of 5-10 years behind bars in New Jersey State Prison. Additionally, a felony assault conviction may carry a presumption of incarceration, which means that the offender could face mandatory prison time if convicted by a jury in the Essex County Superior Court.
